Below is the first in a new series of video blogs that we will be featuring on our appellate blog. Our first video blog, presented by Amy Hocevar and me, addresses en banc practice in the Sixth Circuit. It discusses the “ins and outs” of seeking en banc review of panel decisions and highlights the various pitfalls to avoid. This video blog also includes several important practitioner’s points to consider when deciding whether to file (and, indeed, even when to file) a petition for rehearing en banc in a particular case.
